Terms of Service

These terms are an agreement between you and Mimamo Labs ("Mimamo", "we", "us"), in India. The company, Mimamo Labs Private Limited, is being incorporated; when it is, it takes over these terms and we'll add its registered details here. They cover your use of the website mimamoapp.com, the waitlist and the Mimamo app. By using any of them, you agree to these terms and to our Privacy Policy.

1. What Mimamo is

Mimamo is a tool for personal trainers and their clients. Trainers build workout plans, run sessions and send payment requests. Clients see their trainer's plan, with the trainer's own demo videos, before each session. Mimamo is not a gym, a trainer or a medical service. We provide the software; the training is between you and your trainer.

Before launch, the website lets you join a waitlist. Joining doesn't create an account or any obligation for you or us.

2. Who can use it

You must be 18 or over and able to enter into a binding agreement under Indian law. Trainers must not add anyone under 18 as a client.

3. Your account

  • You sign in with your phone number and a one-time code. Keep your phone and your WhatsApp account secure. Anyone who can receive your codes can sign in as you.
  • Give accurate details and keep them up to date.
  • Tell us at hello@mimamoapp.com if you think someone else has used your account.

4. If you're a trainer

  • You're responsible for your training. The plans, exercises, loads, advice and cues are yours, as is your clients' safety during sessions.
  • You need your clients' permission before you add their details to Mimamo, especially health information. Only add what you need to train them well.
  • Your videos and content must be yours, or you must have the right to use them (for example, a YouTube video you're allowed to share).
  • You're independent. Nothing in Mimamo makes you our employee, agent or partner.
  • You follow the law that applies to your business, including consumer, tax and data-protection law.

5. If you're a client

  • Your trainer decides your plan. If something in a plan doesn't feel right for you, talk to your trainer before doing it.
  • Please only confirm sessions that actually happened, and only mark payments you actually made.

6. Health and safety

Mimamo does not give medical advice. Exercise has risks. Talk to a doctor before starting a new programme, especially if you have a health condition, an injury, or are pregnant. Stop and seek help if you feel pain, dizziness or shortness of breath. We're not responsible for injuries that happen while you train.

7. Payments between trainers and clients

Mimamo never handles money. Clients pay trainers directly (for example by UPI or cash). Payment requests, reminders, claims and receipts in Mimamo are records only. We're not a party to your payment arrangements. We can't refund payments, and we can't settle disputes between trainers and clients.

8. Fees

Mimamo is free while we launch. We may later introduce paid plans for trainers. If we do, we'll tell you the price and terms in advance, and nothing will be charged without your agreement. Clients never pay to use Mimamo.

9. Messages we send

To make Mimamo work, we send service messages: sign-in codes, plans, session and payment reminders, and notices about your account. These go by push notification or WhatsApp. You can turn notifications off in the app or your phone settings. Some messages (like sign-in codes) are needed to use the service. The waitlist sends one message when your city opens.

10. Your content

You keep ownership of what you put into Mimamo (plans, notes, videos). You give us a limited licence to store it, process it and show it to the people you share it with (for example, your clients), only to run the service. The licence ends when you delete the content or your account, except for copies we must keep by law or that sit briefly in backups.

The Mimamo name, logo, app and website are ours. Don't copy them or use them to suggest we endorse you.

11. Things you must not do

  • Break the law, or use Mimamo to harass, deceive or harm anyone.
  • Upload content you don't have the right to share, or that's offensive or unlawful.
  • Try to access other people's data, probe or attack our systems, or get around our limits.
  • Scrape, copy or resell the service, or use it to build a competing product.
  • Impersonate anyone, or send false session or payment records.

12. Changes and availability

We're building Mimamo and it will change. We'll try to keep it available, but we can't promise it will always work without interruption. We may change or stop features. If a change significantly affects you, we'll try to tell you first.

13. Suspending or ending your account

You can delete your account at any time in the app. We may suspend or close an account that breaks these terms or puts others at risk. Where it's reasonable, we'll tell you why first. What happens to your data after that is explained in our Privacy Policy.

14. Our responsibility to you

Mimamo is provided "as is". To the extent the law allows, we aren't liable for:

  • indirect or consequential losses, such as lost income or clients;
  • losses caused by the trainer–client relationship, training or payments between you.

Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.

15. If you're a trainer: indemnity

If a claim is made against us because of your training, your content or your breach of these terms, you agree to cover our reasonable losses and costs arising from it.

16. Law and disputes

These terms are governed by the laws of India. If we can't resolve a dispute by talking, the courts at Bengaluru will have jurisdiction.

17. Changes to these terms

We may update these terms. For significant changes, we'll give notice before they apply. If you keep using Mimamo after that, you accept the new terms. If you don't agree, you can stop using Mimamo and delete your account.
